Tình hình là nó như thế này.

Hôm qua tớ post cái bức thư Cưới em nha anh Tèo lên, có khi nhiều người thấy lạ lắm nhỉ. Nó chỉ là một trong số loạt bài Chuyện thường ngày của Báo Tuổi trẻ online ấy mà. Tớ thì có biệt danh là Quang Tèo nên có lần cụ Long lấy bức thư đó đưa lên diễn đàn chọc tớ :)). Ôi, giá mà có người thực sự viết thư xin tình yêu của tớ như thế nhỉ ;)).

Lạnh. Nghe giang hồ đồn sẽ lạnh như thế này và hơn thế nữa đến ngày 03/01/2009 cơ. Đã thế lại còn mưa, sương mù nữa chứ. Ôi, sáng sớm mở cửa ra mà ko biết là đang mưa hay chỉ có sương nữa, trắng xoá. Nước thì cứ nhỏ tong tong từ trên xuống. Lật đạt cầm ô thì hoá ra, tiên sư nhà chúng nó, giặt đồ phơi đồ ít ra cũng phải vắt cho kỹ chứ, cứ để thế mà đưa lên dây phơi à, làm đồ của mình phơi ở tầng dưới cũng ướt sũng theo. Thế này thì bao h mới khô? :-w. Đúng là bọn ngu lâu dốt bền =)).

Thi cử không ra gì hết trơn. Không học gì. Mà có môn cũng chả có gì để học (vở ko, giáo trình ko,...). Kệ. Đến đâu thì đến! Còn 4 môn nữa thôi. Xong rồi thì làm gì nữa, có trời mới biết :))

Hình như. Có cảm giác là đã coi mình như có cũng đc mà ko có cũng đc thì phải. Thấy im suốt. Mess cũng chỉ qua loa, còn đòi nấu cơm, mời cơm nữa chứ.... Thực ra ý, tớ đã coi như không có rồi. Vì cơ bản ko ai muốn nghĩ đến một người ích kỷ và hời hợt nữa :)

[Anh Tèo yêu dấu] Entry for December 27, 2008




Lâu rồi em mới biên thơ cho anh. Không phải tụi mình xa mặt cách lòng mà do lâu rày em bị ho, sợ khục khặc ra giấy nó lây cho anh thì tội. Anh đừng lo, đốctờ nói em bị bịnh do ô nhiễm. Em cũng không biết ô nhiễm trong nhà máy hay do ăn phở có phọtmôn nữa…

Sao lâu rồi anh không tới dắt em đi dạo? Hay anh sợ đường sá bụi bặm? Đâu có sao, mình chịu khó đeo khẩu trang một chút thôi mà. Có điều khi mình… hun sẽ hơi bất tiện. Nhưng em sẽ chế cái khẩu trang có dây kéo, mình “rẹt” một cái là OK chớ gì! Dành riêng cho anh đó.

Hay là anh đã quên em, chê con sông ngày xưa sau nhà em giờ không còn thơ mộng mà bốc nặng mùi? Nếu vì nó mà tình yêu đôi ta tan vỡ, em sẽ quyết kiện những ông quản lý môi trường. Hôm anh chở em đi coi xinê mà bị kẹt xe do mấy cái lô cốt, anh đã văng tục. Em giận vì nghĩ anh thô bạo. Nhưng giờ thì em đã hiểu vì lúc nào ra đường cũng nghe quá trời tiếng la ó, cãi cọ. Chịu sao thấu, anh hén?

Cưới em nha anh Tèo! Em hứa sẽ tự tay trồng rau, nuôi gà để anh có bữa ăn sạch. Tự em chăn tằm dệt vải để anh có áo quần không nhiễm hóa chất. Sẽ nấu rượu cho anh uống để không nhiễm mêtanôn. Sẽ đẻ con, nuôi con cho anh bằng dòng sữa không nhiễm mêlamin... Chỉ mong anh cầu hôn em bằng lời cầu hôn không ô nhiễm.

Entry for December 19, 2008




Tự nhiên muốn đủ thứ.
Muốn được ngủ một giấc thật bình yên (cho dù dạo này ngủ rất chi là nhiều:)) )
Muốn được trở lại Phan Đình Phùng và Hoàng Diệu với ai đó. Đi bộ thôi, cũng ấm lòng.
Muốn thời gian vừa trôi chậm vừa trôi nhanh cho những ứoc mơ và dự định.
Tự dưng thèm.
Thèm cảm giác đợi chờ ở nhà ga Hàng cỏ. Thèm ghê lắm cảm giác lúc lên tàu, tàu chuyển bành trôi dần ra khỏi HN xuôi về phương Nam nắng ấm... Thèm quay lại cảm giác khi đó, trống vắng và tĩnh lặng....

Hình như mong muốn hơi nhiều thì phải :)
Cho dù chưa có cơ sở vững chắc về tinh thần cũng không bao giờ như thế. KO cần. KO cầu xin!

Tuần rồi là thời gian của những sự trở về và cũng có cả sự gặp gỡ không trọn vẹn….

Vậy là ba má đã lên tàu về nhà hôm kia rồi.

Hồi kia còn nhỏ, nghĩ mọi chuyện khá giản đơn. Cứ tận hưởng hôm nay mà ít khi nghĩ đến ngày mai. Trong con mắt của mình, cuộc sống dường như còn nhỏ bé lắm, chỉ có anh em gia đình và bè bạn. Chỉ đến khi nào cảm nhận được một nỗi buồn khi chia xa, khi ngắm hoa phượng rơi hay nhìn thấy giọt nước mắt của nhỏ bạn bên gốc me…. Hồi đó, nó nhìn mình với ánh mắt khá kỳ lạ mà mãi sau này mới hiểu là nó là thứ tình cảm gì, rồi mới thấy được là tình cảm đó quá đỗi thiêng liêng đến bây giờ không thể quay trở lại. Để rồi thời cấp 3 tinh nghịch trèo cây hái phượng tặng bạn cùng lớp có lần ngã suýt u đầu thế mà tay vẫn cầm nhánh phượng rung rinh ấy, cầm cho đến khi có người đỡ mình dậy mới thôi…. Sao tự dưng lại nhớ đến những kỷ niệm này nhỉ. Có phải khoảng thời gian gần nửa tháng mà ba má ở HN đã làm con nhớ lại chúng hay không? Có lẽ không hẳn thế mà thực ra, nó là những ký ức, có cả ký ức về gia đình mình nữa. Đã bao lần thấy má khóc, khóc thầm lặng, có khi khóc cho một người không đáng nữa. Đến bây giờ, con vẫn thấy một nỗi buồn nào đó hằn sâu trong mắt của má, mãi không phai. Giá như con là người vô tâm, là đứa con chỉ biết ăn chơi,… thì có lẽ con không thấy hụt hẫng như thế này. Đôi lúc, đôi mắt nói lên tất cả, hằn sâu cả thời gian và không gian đã qua làm cho con nao lòng. Hồi trước, mỗi lần má buồn là con lại hận, hận đến xương tủy,.. Có vui không? Không! Có thấy không khí đầm ấm không? Không! Hoàn toàn không. Và khi đó, con cho rằng, chỉ có đi thật xa thì mới thoải mái hơn. Nhưng con đã lầm. Đến bây giờ con nghĩ lại. Con sẽ luôn cười, luôn làm những điều mà đôi khi con không thật sự muốn, sẽ làm tất cả những gì gọi là có thể làm. Má cứ cố gắng khỏe hơn đi nhé, rồi ra HN, rồi con sẽ chở má đi chơi, đi lăng Bác như lời má đã nói với con khi đang ở viện… Hôm nọ khi lên ga, lòng con se lại và không nghĩ được là có thể cry dễ như thế. Nhưng con đã quay đi, ngược lại và có lẽ má không thấy đâu. Nếu như thời gian có quay trở lại,…

Hình như là một sự chờ đợi xen lẫn hy vọng hơi lâu thì phải. Có đôi lúc cũng quên béng đi ngày vừa qua. Nhưng rồi trong lúc đang ho sù sụ cũng len lên xe bus để đi lên đó. Đi hai chuyến mà cảm thấy dài như đi về quê vậy. Nội Bài thật xa, xa thật đấy…When will we be…?

Tình hình thi cử đang vào giai đoạn nước rút. Vừa kết thúc 4 môn chuyên ngành trong 4 chủ nhật. Từ tuần sau lại bắt đầu liên miên 3 môn một tuần cho đến ngày 06/01/09. Chìm trong thi cử!

[Đong đầy] Entry for December 10, 2008




Vẫn chưa quen với việc không phải đi học. Sáng nay 6h tự dưng lại bật dậy định đi học nhưng ngó sang thấy thằng bạn vẫn còn ngủ ngon lành mới nhớ là mình không phải đi học mấy hôm rồi....

Mấy hôm trc sang blog thằng Quốc mà thấy buồn buồn. Nó viết cái entry về buổi học cuối, đến thằng Cường cũng buồn cơ mà.... Nói chung, dù không nói ra nhưng ai cũng có tâm trạng riêng, cũng đều hướng về một suy nghĩ nào đó về chuyện bạn bè, chuyện học hành... Và hình như bây giờ là cả nỗi nhớ đã bắt đầu đong đầy trong suy nghĩ của từng đứa. Buồn chân buồn tay, và suy nghĩ linh tinh...

Chúc bọn mày thi tốt học kỳ cuối của đời sinh viên nhé. Đến 06/01 là thi xong là mỗi đứa đi mỗi nơi roài. Về quê ăn tết rồi đứa đi thực tập, đứa lên HN viết khóa luận, tháng 6/09 ra trường....

Mấy hôm nay nghe nhiều lần bài Mong ước kỷ niệm xưa... Thằng bạn cho mình nghe bài Cơn mưa mùa đông...

Hôm qua có một người "bạn" ra HN. Chẹp! Không biết có suy nghĩ gì không! Nhưng hình như có sự ko vừa lòng ở đây!

Ngày mai hình như có ai đó về VN!

Ngày kia bố mẹ về quê!

Còn hôm nay thì không thể không viết entry này! Nhớ. Mệt. Đong đầy!

Buổi học cuối!




Hôm nay là buổi học cuối cùng của đời sinh viên... Tuần rồi khong đi học được nhưng cũng biết là lớp cũng khá đông, đi nhiều để chụp ảnh kỷ niệm, bàn tán chuyện tương lai. Tuần rồi cũng có khá nhiều chuyện xảy ra, suy nghĩ nhiều, đi nhiều, hò sơ TLBU để chỏng chơ trên mặt bàn phủ bụi. Và cũng thất vọng khá nhiều, nhiều lắm. Bây giờ thì kệ, không nghĩ đến nữa. Không xứng đáng để coi là bạn, chỉ là "người học cùng lớp mà thôi". Lúc đó đã nghĩ là hôm nay sẽ không đi được vì có lẽ sẽ bận. Nhưng rồi hôm nay vẫn đi. Dậy sớm, đến trường khá sớm và ngồi ở bãi cỏ trước nhà C, nhìn nhà A bây giờ chỉ còn là bãi đất trống :)).... Học 4 tiết trôi qua nhanh thật nhanh....

Đi trên đường Pháo Đài, về nhà, thấy hơi nặng trĩu. Tuy biết là chưa xa nơi này đâu, có khi không xa ấy chứ, nhưng vẫn cứ thấy bồn chồn. Chỉ độ hơn nửa tháng nửa thôi là kết thúc kỳ thi HK cuối cùng, mỗi đứa một nơi, mỗi người một ngã,....

Rồi sẽ qua nhanh thời gian này mà thôi. Còn nhiều thứ để lo hơn. Vẫn còn nhớ một câu mà tâm niệm từ lâu: Ý nghĩa của ngày gặp lại là gì, gặp lại không phải để tay bắt mặt mừng mà để thấy là chúng ta còn nhớ về nhau. Chắc chắn là như thế!

Mà hình như thứ 5 này có người về VN thì phải!

Những ngày này chạy như chạy giặc...

Tranh thủ vài giây phút hiếm hoi để online.

Nói chung đã đổi lịch, không phải thứ tư mà là thứ hai, tức là hôm qua. Nhìn chung là ổn cả, không có gì phải lo lắng. Chuyện bây giờ là phải yên tĩnh nghỉ ngơi và chăm sóc thật kỹ. Có lẽ sẽ mất một tuần. Lại như những lần trước. Cũng có những sự khó chịu, những cảm xúc giấu chặt trong lòng, những lần không hiểu nhau,....Nhưng khi nhìn thấy những giọt nước mắt lăn thì lòng se lại. Hồi trước, vẫn vô tư nghĩ rằng không có cũng được, mình sẽ sống đúng là mình. Nhưng bây giờ, khi những nếp nhăn đã hằn lên, sự già nua của tuổi già làm lòng mình lại phải nghĩ lại cho kỹ càng. Nói chung, sẽ bỏ qua tất cả. Vì dù gì cũng là yêu thương, cũng là gia đình của bản thân mình!

Hình như mấy hôm nay trên lớp đông vui lắm. Cũng đúng thôi, những ngày học cuối cùng của đời sinh viên mà. MÌnh thì ko đi học được nhưng có lẽ sẽ cố gắng đến đc một hôm, dù sao thì cũng nên được gặp gỡ một chút!

Con đường em về ban trưa
Hoa tím nghiêng nghiêng đợi chờ
Tuổi em vừa tròn mười bảy
Tóc em vừa chớm ngang vai

Con đường em về mưa bay
Ta đứng trông theo bao ngày
Từ bao giờ lòng cứ ngỡ
Yêu người mà nào có hay!

Ngọc lan khuya rụng trong vườn
Tiếng dương cầm đâu lặng lẽ

Hoa tím ngày xưa, bây giờ cũng đâu còn nữa, ta vẫn chờ đấy thôi...

Chớm đông và LGT!




CHỚM ĐÔNG

Phố đã chớm đông rồi nhóc ạ

Lạnh se se phía lối anh về...

Bởi phía ấy chẳng còn áo đỏ,

Tóc em dài tung gió đạp xe...



Chiều đã chớm đông rồi nhóc ạ

Dăm tiếng chuông xa lắc phủ Tây Hồ

Đêm lạnh xuống gió mùa đông bắc

Thấp thoáng ven hồ, tí tách lửa nướng ngô...



Ốc đã chớm đông rồi nhóc ạ

Nhớ tê tê bát nước chấm ớt gừng

Cái quán cũ xưa mình ngồi đâu nhỉ ?

Ốc nóng lòng chấm lẫn cả nhớ thương...



Mùa đã chớm đông rồi nhóc ạ,

Áo đỏ xưa em ấm ở nơi nào?

Anh rưng rưng xứ mình chớm rét

Gió chuyển mùa trên mái ngói lao xao...
Ngày chớm đông. Hà Nội chìm trong màn sương sớm. Anh quàng khăn đi giữa phố dìu dặt. Thấy Tháp Rùa nghiêng vì nỗi nhớ một người...

Có thể nói đây là một chương trình giao lưu bổ ích mang đến cho các bạn hành trang cần thiết để có thể đạt kết quả cao trong học tập cũng như tạo bước đệm thuận lợi cho quá trình tìm việc sau này.

Con cảm ơn má vì tất cả. Cảm ơn má cho con được vừa có người sinh thành, vừa là người thầy lớn của đời con, mãi mãi không đổi thay. Con tự hào lắm!

Thời gian này con biết má vẫn phải hay ở nhà một mình và sức khỏe không tốt như trước. Con cầu mong mọi điều sẽ tốt đẹp cả. Tết con sẽ về mà!

Trên những nẻo đường của Tổ quốc xanh tươi.

Có những loài hoa thơm đậm đà sắc hương.

Có những bài ca nghe rạo rực lòng người.

Bài ca ấy loài hoa ấy đẹp như em, người giáo viên nhân dân.

Tâm hồn em tươi mát xanh như bóng lá bang.

Như chim bay về khắp miền, em lên đường, tung bay xây nhiều thế hệ cháu Bác Hồ.

Năm nay thi Học kỳ sớm. Kỳ thi học kỳ cuối của đời sinh viên. Nghe cũng đáng nhớ ấy nhỉ! Có quá lo không? 14 môn mà thi nhanh chóng vánh. Thi 4 môn chuyên ngành trước trong 4 chủ nhật liên tiếp. Tuần sau thi rồi. Rồi đến 15/12 thi chính thức luôn.
Sắp được nghỉ học.
Sắp không được gặp bạn bè thường xuyên nữa.
Sau HK này, không phải thức đêm học ôn thi cả tháng trời, không gầy rộc đi nữa, ko phờ phạc đi nữa. Và có lẽ sẽ béo hơn :)).
Nhưng cũng sẽ thấy cô đơn hơn...
Sắp đến ngày đó rồi. Cữ ngỡ là trùng vào hôm thi nào đó, nhưng cuối cùng lại không phải, may quá.
Đóng cửa thi học kỳ!

Hôm qua có được gọi là sự sa đọa không nhỉ? Hình như là có. Thực ra là đi nhậu không có lỗi. Chỉ tội lỗi với bản thân này mà thôi, chí ít là với một đứa như mình! Vì sao lại thế?

Hôm nay là một năm ngày mất của cụ. Một năm rồi nhỉ. Con còn nhớ cái ngày cụ đi ô tô từ Nghệ An vào Quảng Ngãi cùng với ông bà ngoại. Hồi ấy cụ đã hơn 90 rồi nhé. Thế mà, cụ chỉ ở với con được có gần 3 năm mà thôi. Con biết là cụ rất thương con, thương không phải chỉ bằng hành động mà còn là ánh nhìn, là cử chỉ dịu dàng và ánh mắt nồng ấm. Con cũng vậy. Cả nhà vẫn hay đùa với nhau, con mới có gần 20 tuổi mà đọc báo cần mang kính, còn cụ hơn 90 rồi mà có cần đến kính đâu. Thế mà.... Con còn nhớ ngày này năm trước. Hà Nội cũng đã bắt đầu lành lạnh như thế này. Còn ở nhà lúc đó mưa như trút nước. Nghe tin mà con quặn cả lòng. Cả nhà không cho con về. Không về được. Tết về, đi tảo mộ, con khóc! Năm nay ngược lại. HN vừa qua một đợt lũ, nắng cũng đã hửng, trời đã lạnh rồi còn ở nhà lại mưa gió không ngừng...Nhớ!

Tin tưởng vào mình nhiều lắm ư? Khi mà bao nhiêu đứa khác nhận hàng chục cú điện thoại, còn bản thân mình lại lầm lũi. Điện về cũng chỉ để nghe những câu cũ, tưởng chừng như hờ hững. KHông gọi về thì cũng không bao giờ gọi ra. Tin tưởng nhiều lắm. Và con cũng đã phấn đấu nhiều lắm. Có phải con không làm được những gì mà mọi người mong mỏi hay không? Có phải con quá vô dụng không? Mọi chuyện sẽ tốt mà. Tết này con lại về mà. Mái ấm!

Nếu vẫn như thế này sẽ còn đi nữa!

Hôm nay đi, thực ra là không muốn đi.

Lại đi.

Bia + rượu + pepsi = điên. Đi bộ về nhà vẫn không thấy gì. Về nhà ngỡ mình say. Hóa ra không phải. Chỉ là điên, đau vì mớ thập cẩm kia mà thôi. Thế thôi.

Vui không? Có.

Tột cùng rồi. Mệt quá!

Cái này cũng lâu lâu rồi, hôm 20/10 tại nhà Hương còi. Thực đơn: bún thịt nướng và hoa quả dầm. Vui. Dưng mà thiếu Thủy ú và Ngọc tu hú =)) :X :*. Lúc ấy kính mắt đang trễ xuống nên lại nhìn ngược lên, hóa ra lại nhìn trừng trừng :((. Các nàng đang mời ta hoa quả dầm ế ;)) :X.

Tình hình hiện tại:

- Cân nặng khoảng 65kg, Cao khoảng 1.71cm.

- Béo quay quắt như con lật đật, có khi lật ko nằm lên được ấy chứ.

- Tàn tạ. Đang bị nổi mày đay mãi ko hết được. Lại phải kiêng ăn thức ăn nóng.

- Mệt mỏi vì nhiều chuyện.

- Buồn.

Rét đầu đông rồi. Sẽ qua nhanh tháng 11 lắm đây, qua nhanh mà thôi bởi thời gian này như ngừng lại, lắng đọng. Mọi việc dù lớn, dù bé cũng không quá quan trọng nữa. Mọi người vẫn đang chạy đua cho kỳ cuối, cho thời gian cuối, nhưng vẫn có cái rét níu kéo, vẩn vơ. Sẽ tốt thôi mà!

Rồi sẽ lại đến tháng 12, nhanh lắm. Ngày đó! :) Liệu có nên….

Tháng 1 sẽ được về nhà.

Nhớ mùa thu! Dù thực sự chưa được ngắm mùa thu đúng nghĩa ở Hà Nội....

DIRECTIVE 97/55/EC OF EUROPEAN PARLIAMENT AND OF THE COUNCIL of 6 October 1997

amending Directive 84/450/EEC concerning misleading advertising so as to include comparative advertising

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 100a thereof,

Having regard to the proposal from the Commission (1),

Having regard to the opinion of the Economic and Social Committee (2),

Acting in accordance with the procedure laid down in Article 189b of the Treaty (3), in the light of the joint text approved by the Conciliation Committee on 25 June 1997,

(1) Whereas one of the Community's main aims is to complete the internal market; whereas measures must be adopted to ensure the smooth running of the said market; whereas the internal market comprises an area which has no internal frontiers and in which goods, persons, services and capital can move freely;

(2) Whereas the completion of the internal market will mean an ever wider range of choice; whereas, given that consumers can and must make the best possible use of the internal market, and that advertising is a very important means of creating genuine outlets for all goods and services throughout the Community, the basic provisions governing the form and content of comparative advertising should be uniform and the conditions of the use of comparative advertising in the Member States should be harmonized; whereas if these conditions are met, this will help demonstrate objectively the merits of the various comparable products; whereas comparative advertising can also stimulate competition between suppliers of goods and services to the consumer's advantage;

(3) Whereas the laws, regulations and administrative provisions of the individual Member States concerning comparative advertising differ widely; whereas advertising reaches beyond the frontiers and is received on the territory of other Member States; whereas the acceptance or non-acceptance of comparative advertising according to the various national laws may constitute an obstacle to the free movement of goods and services and create distortions of competition; whereas, in particular, firms may be exposed to forms of advertising developed by competitors to which they cannot reply in equal measure; whereas the freedom to provide services relating to comparative advertising should be assured; whereas the Community is called on to remedy the situation;

(4) Whereas the sixth recital of Council Directive 84/450/EEC of 10 September 1984 relating to the approximation of laws, regulations and administrative provisions of the Member States concerning misleading advertising (4) states that, after the harmonization of national provisions against misleading advertising, 'at a second stage . . ., as far as necessary, comparative advertising should be dealt with, on the basis of appropriate Commission proposals`;

(5) Whereas point 3 (d) of the Annex to the Council Resolution of 14 April 1975 on a preliminary programme of the European Economic Community for a consumer protection and information policy (5) includes the right to information among the basic rights of consumers; whereas this right is confirmed by the Council Resolution of 19 May 1981 on a second programme of the European Economic Community for a consumer protection and information policy (6), point 40 of the Annex, which deals specifically with consumer information; whereas comparative advertising, when it compares material, relevant, verifiable and representative features and is not misleading, may be a legitimate means of informing consumers of their advantage;

(6) Whereas it is desirable to provide a broad concept of comparative advertising to cover all modes of comparative advertising;

(7) Whereas conditions of permitted comparative advertising, as far as the comparison is concerned, should be established in order to determine which practices relating to comparative advertising may distort competition, be detrimental to competitors and have an adverse effect on consumer choice; whereas such conditions of permitted advertising should include criteria of objective comparison of the features of goods and services;

(8) Whereas the comparison of the price only of goods and services should be possible if this comparison respects certain conditions, in particular that it shall not be misleading;

(9) Whereas, in order to prevent comparative advertising being used in an anti-competitive and unfair manner, only comparisons between competing goods and services meeting the same needs or intended for the same purpose should be permitted;

(10) Whereas the international conventions on copyright as well as the national provisions on contractual and non-contractual liability shall apply when the results of comparative tests carried out by third parties are referred to or reproduced in comparative advertising;

(11) Whereas the conditions of comparative advertising should be cumulative and respected in their entirety; whereas, in accordance with the Treaty, the choice of forms and methods for the implementation of these conditions shall be left to the Member States, insofar as those forms and methods are not already determined by this Directive;

(12) Whereas these conditions should include, in particular, consideration of the provisions resulting from Council Regulation (EEC) No 2081/92 of 14 July 1992 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs (7), and in particular Article 13 thereof, and of the other Community provisions adopted in the agricultural sphere;

(13) Whereas Article 5 of First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (8) confers exclusive rights on the proprietor of a registered trade mark, including the right to prevent all third parties from using, in the course of trade, any sign which is identical with, or similar to, the trade mark in relation to identical goods or services or even, where appropriate, other goods;

(14) Whereas it may, however, be indispensable, in order to make comparative advertising effective, to identify the goods or services of a competitor, making reference to a trade mark or trade name of which the latter is the proprietor;

(15) Whereas such use of another's trade mark, trade name or other distinguishing marks does not breach this exclusive right in cases where it complies with the conditions laid down by this Directive, the intended target being solely to distinguish between them and thus to highlight differences objectively;

(16) Whereas provisions should be made for the legal and/or administrative means of redress mentioned in Articles 4 and 5 of Directive 84/450/EEC to be available to control comparative advertising which fails to meet the conditions laid down by this Directive; whereas according to the 16th recital of the Directive, voluntary control by self-regulatory bodies to eliminate misleading advertising may avoid recourse to administrative or juridical action and ought therefore to be encouraged; whereas Article 6 applies to unpermitted comparative advertising in the same way;

(17) Whereas national self-regulatory bodies may coordinate their work through associations or organizations established at Community level and inter alia deal with cross-border complaints;

(18) Whereas Article 7 of Directive 84/450/EEC allowing Member States to retain or adopt provisions with a view to ensuring more extensive protection for consumers, persons carrying on a trade, business, craft or profession, and the general public, should not apply to comparative advertising, given that the objective of amending the said Directive is to establish conditions under which comparative advertising is permitted;

(19) Whereas a comparison which presents goods or services as an imitation or a replica of goods or services bearing a protected trade mark or trade name shall not be considered to fulfil the conditions to be met by permitted comparative advertising;

(20) Whereas this Directive in no way affects Community provisions on advertising for specific products and/or services or restrictions or prohibitions on advertising in particular media;

(21) Whereas, if a Member State, in compliance with the provisions of the Treaty, prohibits advertising regarding certain goods or services, this ban may, whether it is imposed directly or by a body or organization responsible under the law of that Member State for regulating the exercise of a commercial, industrial, craft or professional activity, be extended to comparative advertising;

(22) Whereas Member States shall not be obliged to permit comparative advertising for goods or services on which they, in compliance with the provisions of the Treaty, maintain or introduce bans, including bans as regards marketing methods or advertising which targets vulnerable consumer groups; whereas Member States may, in compliance with the provisions of the Treaty, maintain or introduce bans or limitations on the use of comparisons in the advertising of professional services, whether imposed directly or by a body or organization responsible under the law of the Member States for regulating the exercise of a professional activity;

(23) Whereas regulating comparative advertising is, under the conditions set out in this Directive, necessary for the smooth running of the internal market and whereas action at Community level is therefore required; whereas the adoption of a Directive is the appropriate instrument because it lays down uniform general principles while allowing the Member States to choose the form and appropriate method by which to attain these objectives; whereas it is in accordance with the principle of subsidiarity,

HAVE ADOPTED THIS DIRECTIVE:

Article 1

Directive 94/450/EEC is hereby amended as follows:

(1) The title shall be replaced by the following:

'Council Directive of 10 September 1984 concerning misleading and comparative advertising`;

(2) Article 1 shall be replaced by the following:

'Article 1

The purpose of this Directive is to protect consumers, persons carrying on a trade or business or practising a craft or profession and the interests of the public in general against misleading advertising and the unfair consequences thereof and to lay down the conditions under which comparative advertising is permitted.`;

(3) The following point shall be inserted in Article 2:

'2a "comparative advertising" means any advertising which explicitly or by implication identifies a competitor or goods or services offered by a competitor;`

(4) The following Article shall be added:

'Article 3a

1. Comparative advertising shall, as far as the comparison is concerned, be permitted when the following conditions are met:

(a) it is not misleading according to Articles 2 (2), 3 and 7 (1);

(b) it compares goods or services meeting the same needs or intended for the same purpose;

(c) it objectively compares one or more material, relevant, verifiable and representative features of those goods and services, which may include price;

(d) it does not create confusion in the market place between the advertiser and a competitor or between the advertiser's trade marks, trade names, other distinguishing marks, goods or services and those of a competitor;

(e) it does not discredit or denigrate the trade marks, trade names, other distinguishing marks, goods, services, activities, or circumstances of a competitor;

(f) for products with designation of origin, it relates in each case to products with the same designation;

(g) it does not take unfair advantage of the reputation of a trade mark, trade name or other distinguishing marks of a competitor or of the designation of origin of competing products;

(h) it does not present goods or services as imitations or replicas of goods or services bearing a protected trade mark or trade name.

2. Any comparison referring to a special offer shall indicate in a clear and unequivocal way the date on which the offer ends or, where appropriate, that the special offer is subject to the availability of the goods and services, and, where the special offer has not yet begun, the date of the start of the period during which the special price or other specific conditions shall apply.`;

(5) The first and second subparagraphs of Article 4 (1) shall be replaced by the following:

'1. Member States shall ensure that adequate and effective means exist to combat misleading advertising and for the compliance with the provisions on comparative advertising in the interests of consumers as well as competitors and the general public.

Such means shall include legal provisions under which persons or organizations regarded under national law as having a legitimate interest in prohibiting misleading advertising or regulating comparative advertising may:

(a) take legal action against such advertising; and/or

(b) bring such advertising before an administrative authority competent either to decide on complaints or to initiate appropriate legal proceedings.`;

(6) Article 4 (2) is hereby amended as follows:

(a) the indents in the first subparagraph shall be replaced by the following:

'- to order the cessation of, or to institute appropriate legal proceedings for an order for the cessation of, misleading advertising or unpermitted comparative advertising, or

- if the misleading advertising or unpermitted comparative advertising has not yet been published but publication is imminent, to order the prohibition of, or to institute appropriate legal proceedings for an order for the prohibition of, such publication,`;

(b) the introductory wording to the third subparagraph shall be replaced by the following:

'Furthermore, Member States may confer upon the courts or administrative authorities powers enabling them, with a view to eliminating the continuing effects of misleading advertising or unpermitted comparative advertising, the cessation of which has been ordered by a final decision:`;

(7) Article 5 shall be replaced by the following:

'Article 5

This Directive does not exclude the voluntary control, which Member States may encourage, of misleading or comparative advertising by self-regulatory bodies and recourse before such bodies are in addition to the court of administrative proceedings referred to in that Article.`;

(8) Article 6 (a) shall be replaced by the following:

'(a) to require the advertiser to furnish evidence as to the accuracy of factual claims in advertising if, taking into account the legitimate interest of the advertiser and any other party to the proceedings, such a requirement appears appropriate on the basis of the circumstances of the particular case and in the case of comparative advertising to require the advertiser to furnish such evidence in a short period of time; and`;

(9) Article 7 shall be replaced by the following:

'Article 7

1. This Directive shall not preclude Member States from retaining or adopting provisions with a view to ensuring more extensive protection, with regard to misleading advertising, for consumers, persons carrying on a trade, business, craft or profession, and the general public.

2. Paragraph 1 shall not apply to comparative advertising as far as the comparison is concerned.

3. The provisions of this Directive shall apply without prejudice to Community provisions on advertising for specific products and/or services or to restrictions or prohibitions on advertising in particular media.

4. The provisions of this Directive concerning comparative advertising shall not oblige Member States which, in compliance with the provisions of the Treaty, maintain or introduce advertising bans regarding certain goods or services, whether imposed directly or by a body or organization responsible, under the law of the Member States, for regulating the exercise of a commercial, industrial, craft or professional activity, to permit comparative advertising regarding those goods or services. Where these bans are limited to particular media, the Directive shall apply to the media not covered by these bans.

5. Nothing in this Directive shall prevent Member States from, in compliance with the provisions of the Treaty, maintaining or introducing bans or limitations on the use of comparisons in the advertising of professional services, whether imposed directly or by a body or organization responsible, under the law of the Member States, for regulating the exercise of a professional activity.`

Article 2

Complaints systems

The Commission shall study the feasibility of establishing effective means to deal with cross-border complaints in respect of comparative advertising. Within two years after the entry into force of this Directive the Commission shall submit a report to the European Parliament and the Council on the results of the studies, accompanied if appropriate by proposals.

Article 3

1. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive at the latest 30 months after its publication in the Official Journal of the European Communities. They shall forthwith inform the Commission thereof.

2. When Member States adopt these measures, they shall contain a reference to this Directive or shall be accompanied by such reference on the occasion of their official publication. The methods of making such reference shall be laid down by Member States.

3. Member States shall communicate to the Commission the text of the main provisions of domestic law which they adopt in the field governed by this Directive.

Article 4

This Directive is addressed to the Member States.

THE COUNCIL OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 100 thereof,

Having regard to the proposal from the Commission (1),

Having regard to the opinion of the European Parliament (2),

Having regard to the opinion of the Economic and Social Committee (3),

Whereas the laws against misleading advertising now in force in the Member States differ widely; whereas, since advertising reaches beyond the frontiers of individual Member States, it has a direct effect on the establishment and the functioning of the common market;

Whereas misleading advertising can lead to distortion of competition within the common market;

Whereas advertising, whether or not it induces a contract, affects the economic welfare of consumers;

Whereas misleading advertising may cause a consumer to take decisions prejudicial to him when acquiring goods or other property, or using services, and the differences between the laws of the Member States not only lead, in many cases, to inadequate levels of consumer protection, but also hinder the execution of advertising campaigns beyond national boundaries and thus affect the free circulation of goods and provision of services;

Whereas the second programme of the European Economic Community for a consumer protection and information policy (4) provides for appropriate action for the protection of consumers against misleading and unfair advertising;

Whereas it is in the interest of the public in general, as well as that of consumers and all those who, in competition with one another, carry on a trade, business, craft or profession, in the common market, to harmonize in the first instance national provisions against misleading advertising and that, at a second stage, unfair advertising and, as far as necessary, comparative advertising should be dealt with, on the basis of appropriate Commission proposals;

Whereas minimum and objective criteria for determining whether advertising is misleading should be established for this purpose;

Whereas the laws to be adopted by Member States against misleading advertising must be adequate and effective;

Whereas persons or organizations regarded under national law as having a legitimate interest in the matter must have facilities for initiating proceedings against misleading advertising, either before a court or before an administrative authority which is competent to decide upon complaints or to initiate appropriate legal proceedings;

Whereas it should be for each Member State to decide whether to enable the courts or administrative authorities to require prior recourse to other established means of dealing with the complaint;

Whereas the courts or administrative authorities must have powers enabling them to order or obtain the cessation of misleading advertising;

Whereas in certain cases it may be desirable to prohibit misleading advertising even before it is published; whereas, however, this in no way implies that Member States are under an obligation to introduce rules requiring the systematic prior vetting of advertising;

Whereas provision should be made for accelerated procedures under which measures with interim or definitive effect can be taken;

Whereas it may be desirable to order the publication of decisions made by courts or administrative authorities or of corrective statements in order to eliminate any continuing effects of misleading advertising;

Whereas administrative authorities must be impartial and the exercise of their powers must be subject to judicial review;

Whereas the voluntary control exercised by self-regulatory bodies to eliminate misleading advertising may avoid recourse to administrative or judicial action and ought therefore to be encouraged;

Whereas the advertiser should be able to prove, by appropriate means, the material accuracy of the factual claims he makes in his advertising, and may in appropriate cases be required to do so by the court or administrative authority;

Whereas this Directive must not preclude Member States from retaining or adopting provisions with a view to ensuring more extensive protection of consumers, persons carrying on a trade, business, craft or profession, and the general public,

HAS ADOPTED THIS DIRECTIVE:

Article 1

The purpose of this Directive is to protect consumers, persons carrying on a trade or business or practising a craft or profession and the interests of the public in general against misleading advertising and the unfair consequences thereof.

Article 2

For the purposes of this Directive:

1. 'advertising' means the making of a representation in any form in connection with a trade, business, craft or profession in order to promote the supply of goods or services, including immovable property, rights and obligations;

2. 'misleading advertising' means any advertising which in any way, including its presentation, deceives or is likely to deceive the persons to whom it is addressed or whom it reaches and which, by reason of its deceptive nature, is likely to affect their economic behaviour or which, for those reasons, injures or is likely to injure a competitor;

3. 'person' means any natural or legal person.

Article 3

In determining whether advertising is misleading, account shall be taken of all its features, and in particular of any information it contains concerning:

(a) the characteristics of goods or services, such as their availability, nature, execution, composition, method and date of manufacture or provision, fitness for purpose, uses, quantity, specification, geographical or commercial origin or the results to be expected from their use, or the results and material features of tests or checks carried out on the goods or services;

(b) the price or the manner in which the price is calculated, and the conditions on which the goods are supplied or the services provided;

(c) the nature, attributes and rights of the advertiser, such as his identity and assets, his qualifications and ownership of industrial, commercial or intellectual property rights or his awards and distinctions.

Article 4

1. Member States shall ensure that adequate and effective means exist for the control of misleading advertising in the interests of consumers as well as competitors and the general public. Such means shall include legal provisions under which persons or organizations regarded under national law as having a legitimate interest in prohibiting misleading advertising may:

(a) take legal action against such advertising; and/or

(b) bring such advertising before an administrative authority competent either to decide on complaints or to initiate appropriate legal proceedings.

It shall be for each Member State to decide which of these facilities shall be available and whether to enable the courts or administrative authorities to require prior recourse to other established means of dealing with complaints, including those referred to in Article 5.

2. Under the legal provisions referred to in paragraph 1, Member States shall confer upon the courts or administrative authorities powers enabling them, in cases where they deem such measures to be necessary taking into account all the interests involved and in particular the public interest:

- to order the cessation of, or to institute appropriate legal proceedings for an order for the cessation of, misleading advertising, or

- if misleading advertising has not yet been published but publication is imminent, to order the prohibition of, or to institute appropriate legal proceedings for an order for the prohibition of, such publication, even without proof of actual loss or damage or of intention or negligence on the part of the advertiser.

Member States shall also make provision for the measures referred to in the first subparagraph to be taken under an accelerated procedure:

- either with interim effect, or

- with definitive effect, on the understanding that it is for each Member State to decide which of the two options to select.

Furthermore, Member States may confer upon the courts or administrative authorities powers enabling them, with a view to eliminating the continuing effects of misleading advertising the cessation of which has been ordered by a final decision:

- to require publication of that decision in full or in part and in such form as they deem adequate,

- to require in addition the publication of a corrective statement.

3. The administrative authorities referred to in paragraph 1 must:

(a) be composed so as not to cast doubt on their impartiality;

(b) have adequate powers, where they decide on complaints, to monitor and enforce the observance of their decisions effectively;

(c) normally give reasons for their decisions.

Where the powers referred to in paragraph 2 are exercised exclusively by an administrative authority, reasons for its decisions shall always be given. Furthermore in this case, provision must be made for procedures whereby improper or unreasonable exercise of its powers by the administrative authority or improper or unreasonable failure to exercise the said powers can be the subject of judicial review.

Article 5

This Directive does not exclude the voluntary control of misleading advertising by self-regulatory bodies and recourse to such bodies by the persons or organizations referred to in Article 4 if proceedings before such bodies are in addition to the court or administrative proceedings referred to in that Article.

Article 6

Member States shall confer upon the courts or administrative authorities powers enabling them in the civil or administrative proceedings provided for in Article 4:

(a) to require the advertiser to furnish evidence as to the accuracy of factual claims in advertising if, taking into account the legitimate interests of the advertiser and any other party to the proceedings, such a requirement appears appropriate on the basis of the circumstances of the particular case; and

(b) to consider factual claims as inaccurate if the evidence demanded in accordance with (a) is not furnished or is deemed insufficient by the court or administrative authority.

Article 7

This Directive shall not preclude Member States from retaining or adopting provisions with a view to ensuring more extensive protection for consumers, persons carrying on a trade, business, craft or profession, and the general public.

Article 8

Member States shall bring into force the measures necessary to comply with this Directive by 1 October 1986 at the latest. They shall forthwith inform the Commission thereof.

Member States shall communicate to the Commission the text of all provisions of national law which they adopt in the field covered by this Directive.

Article 9

This Directive is addressed to the Member States.

Comparative Advertising in German Law



Competition is a constituent part of the economic organization of the Federal Republic of Germany. It accommodates the success of the victorious as well as the failings of the less fortunate. In order to prevent the system degenerating into a fight of all against all, the law of competition has invented an important corrective, namely the idea of performance competition (Leistungswettbewerb).

The Act against Unfair Competition on 7 June 1909 (Gesetz gegen den unlauteren Wettbewerb UWG) determines that the advantages a competitor wishes to obtain in competition should be based exclusively on his own achievements, and not through acting unfairly.

Advertising fits in perfectly well with this juridical system. It is unnecessary to underline here that it is not enough to have a superior product if a company wants to beat its competitors. Top performance must necessarily be accompanied by efficient advertising and well-organised marketing.

Competition law regards advertising as an essential element of free competition and accepts it in the interest of market transparency and the free formation of prices.

Publicity being the most efficient means of increasing sales to the disadvantage of competitors, the temptation to abuse it is naturally quite strong. This is why the principle of free competition imposes certain limits on advertising. Free competition is affected as soon as the advertising target is influenced by false, deceptive or ambiguous information, or is misled into irrational purchasing decisions. Here advertising becomes the contrary of what the legislator wants: it does not contribute to market transparency or act as a corrective to price fixing; instead it disinforms,veils market conditions or even leads to illogical decisions being made by a purchaser.

The juridical phenomenon of comparative advertising is regulated by the provisions in paragraphs 1 and 14 UWG. In order to systematize the large area of application of these legal provisions, legal doctrine has introduced a distinction between “personal” advertising (persönliche Werbung – referring, for example, to the nationality of a competitor, his family affairs, his religion,state of health, character etc.) and “comparative” advertising in the stricter sense.1

Personal advertising is considered to be unfair from the moment it unwarrantedly impinges on the competitor by a disregard for the truth of statements in the advertisement. Comparative advertising in the narrower sense can include a competitor referring to the products or services of another competitor either “positively” by trying to profit from the latter’s good commercial standing, or with the specific negative intention of discrediting the competitor or his products in the eyes of his customer (for example, “Compared to our products, everything else is low tech!”).

The same rule applies to cases – even where the statements are materially true – which depreciate or denigrate one or more specific competitors by using global assertions (for example, “We refrain from expensive advertising, as we have always preferred to use what we save to improve our products!”). Positive parasitical comparative advertising is prohibited because it is seen as unfair exploitation of the good standing of a third party.2

In the case of critical (negative) comparative advertising, German law, like French and Belgian law, has decided to adopt a system of absolute prohibition.3 This principle, however, is not applied in a rigid manner. German jurisprudence has, on the contrary, developed a flexible system which, however, unfortunately does not sufficiently ensure an unequivocal administration of the law. Following a number of decisions by the German Federal Supreme Court (Bundesgerichtshof (BGH)), the highest authority on this subject, advertising that refers critically to services or products of one or more particular competitors is only permissible where it is justified by a sufficient and creditable motive (“hinreichender Anlass”);4 where the assertions, in terms of their nature, style and tone, confine themselves to what is absolutely necessary to the safeguarding of legitimate interests; and where they do not go beyond a true and objective discussion.5

Judicially, the crucial point of comparison advertising can be seen in the concept of sufficient and creditable motive (“hinreichender Anlass”). German case law has established that this concept must be interpreted restrictively, because each advertisement that underlines the qualities of a company’s own products or services by accentuating the detects or disadvantages of those of its competitors is deemed to be fundamentally contrary to the idea of performance competition.6 In the interests of a practicable application of the concept “hinreichender Anlass”, it has been established that the mere desire of a merchant to sell does not suffice to justify comparative advertising criticizing particular competitors.7 Approved comparative advertising must be set in an exceptional situation in which the interest in publishing it prevails over the competitor’s interest in not being the subject of it. Such an exceptional situation will only be found if:
• the consumer urgently needs to receive objective information; or
• comparative advertising is needed to rebut the wrongful attach of a competitor, who, for instance, propagates false assertions or statements likely to mislead consumers in respect of a foreign product.
In all cases – according to the case law – it is essential that the declarations made confine themselves in nature and scope to what is strictly necessary, first to inform the consumer, and second to ward off an attack.
The first instance cited above (information for the consumer) may be subdivided as follows:
• comparison at the request of clients (neither provocated nor manipulated, of course),
• comparison of different systems or products or services (for example, comparison of diesel and petrol engines; of alcoholic and non-alcoholic drinks; of mass-produced and handmade products; of gas heating and oil-fired heating and so forth),
• indispensable comparison, for example for the protection of consumers from danger caused by a competitor’s products, or information about real technical progress (for instance comparison of cars with and without catalytic converters).

The right to rebut must, in each individual case, serve exclusively to ward off a competitor’s attack. The rebuttal must remain objective and in reasonable proportion to the attack, and must be moderate in its nature, tone and extent.

In all these cases, the notion of comparative advertising presupposes that there is a comparison with one or more specific competitors. Where advertising does not refer either explicitly or tacitly to the products or services of one or more defined enterprises, there is no “comparison”.
Furthermore, where comparative advertising does not characterise competitive products as being objectively inferior, such comparison lacks depreciating elements and cannot be restrained.8

It can provisionally be concluded that German law basically prohibits comparative advertising on principle. Nevertheless, it admits – within narrow limits – a number of interesting exceptions. It is possible to detect in recent decisions – with reservations – a certain tendency to greater tolerance towards comparative advertising. The courts seem to be developing – following an important strand in legal writing – a certain tendency to accord to enterprises the right to grapple with the products or services of their competitors on condition that the exercise is guided by an objective and acceptable motive, and that comparative advertising, in regard to its content and form, stays within the limits of what is necessary and appropriate.However, this jurisprudence has not so far managed to provide sufficiently clear, certain and practicable definitions of these permissible exceptions. It is not clear at what point the motive for comparative advertising is considered acceptable (“hinreichender Anlass”) and what “necessary and appropriate” means in this context.9 So long as the law is not more specific and clearly defined, it is advisable to refrain from practising comparative advertising in Germany. There is considerable divergence among national provisions within EEC Member States.
Whereas English law, for instance, is quite tolerant towards comparative advertising, German law – like French and Belgian – can be considered hostile in principle to such activity.

The EEC Directive of 1984 (84/450) on Misleading Advertising, while aiming to harmonise the legal rules and regulations of the Member States relating to this kind of advertising, whether comparative or not, did not lead to a rapprochement between German law and other diverging systems. This was due to the fact that the Federal Government took the view that the German legal provisions were in perfect accord with the demands of the Directive. However that may be, it cannot be denied that the consequences of German law could impede merchants from countries with more liberal regulations in the field of unfair and comparative advertising, who wish to accompany their exports to Germany by the sort of publicity campaigns they are used to practising in their home countries. Hence the question arises whether German law does not infringe Article 30 of the EEC Treaty, insofar as it, in effect, quantitatively limits imports. Interested groups are discussing this problem intensively and expect that the European Court of Justice will soon give an opinion as to whether the German situation, as reflected in the courts’ decisions, does or does not harmonise with the EEC Treaty.
